What does adverse possession mean in Minnesota?

Adverse possession refers to one person challenging the ownership of another person to a piece of real property. Several factors must exist for a successful adverse possession claim:

For a successful claim, the possession must be:

  • Visible and physical
  • Exclusive
  • Continuous (for at least fifteen years)
  • Adverse (without the property owner’s permission)

A common example of an adverse possession claim is when a neighboring landowner continuously and exclusively uses and maintains a portion of their neighbor’s property.

What is a quiet title action?

If someone needs to regain ownership of their real property, they can file a quiet title action to challenge the claim of a past or present owner to the property. The phrase “quiet title action” refers to the plaintiff’s purpose of quieting any existing claims to the title.

What should I do if I have a boundary dispute with my neighbor?

Most boundary disputes find resolutions without having to go to court. You can try to do this by ordering a land survey and a title search. If you and your neighbor still do not agree, a boundary dispute lawyer can assist you in filing a lawsuit to have a Minnesota court issue a decision.

How does a mechanic’s lien work?
